Legislation in the field of ecological environment will promote the harmonious coexistence between man and nature
The number of wild animals, the number of population is to test the ecological environment good or bad “barometer”.The improvement of ecological environment is inseparable from the perfection of special laws in the field of environmental protection. From the Wildlife Protection Law revised in 2018, to the Yangtze River Protection Law, which will take effect on March 1, 2021, to the Wetland Protection Law, which will take effect on June 1, this year, we have constantly improved our legal system for ecological and environmental protection, providing a legal barrier for protecting our clear waters and lush mountains.Since the beginning of winter, flocks of rare migratory birds, such as great bustard, gray crane and white swan, have been playing leisurely and feeding, or flapping their wings and circling in the Dali section of shaanxi Yellow River wetland, adding vitality to the winter wetland. At The Longhu Mountain scenic spot in Jiangxi Province, the “old friends” of forest ranger Xiao Dong-xiang came as expected. These Chinese mergansers either played on the water with their spotted bill ducks, or lay quietly on the river or exposed rocks in the water, listening to the musical concerto of nature. The Chinese merganser, an endangered species and first-level protected wild animal, usually overwinters at Longhu Mountain from early November to March, xiao said.It has been 15 years since the first visit in 2007.Rangers found two “new friends” in the Yeyahu Wetland in Yanqing district of Beijing, which is the first time red-crowned cranes have been found in yanqing district. From south to north, good wetland ecological environment is the key to attract “old and new friends” to live.According to Liu Hongyan, director of the Ecological Law Department of the Law Institute of the Chinese Academy of Social Sciences, wetlands are recognized as the “kidney” of the earth, along with forests and oceans, as one of the three major systems of the earth.Wetland for environmental protection, especially the role of ecological protection is very significant, for example, can purify water, can conserve water, can fight floods, can regulate biological diversity, including climate change and so on, these are important reasons to protect wetlands. From June 1 this year, the Wetland Protection Law of the People’s Republic of China came into effect, which is China’s first law on wetland protection. It not only clearly defines the scope of wetland protection, but also systematically protects wetlands as a whole. To adapt to nature, protect nature and protect biodiversity, we need to build a high-quality ecological protection system to promote high-quality development with high-level protection. The idea runs through watershed and land conservation legislation. On March 1, 2021, the Yangtze River Protection Law came into effect, and the Yellow River Protection Law (draft) has also been deliberated. The Yellow River Protection Law (draft) contains 105 articles in 11 chapters. The legislation is problem-oriented and protects the Yellow River from the aspects of water-sediment relationship, water resources and high-quality development. As well as the Yellow River Protection Law (draft), another piece of legislation with a special location has drawn much attention: the Black Land Protection Law (draft), which was submitted to the Standing Committee of the National People’s Congress for deliberation on December 20, 2021.Due to the scarcity and preciousness of resources, black land is also known as the “giant panda in arable land”.Once upon a time, the black soil nourished sorghum fertilizer soybean fragrance, but the former fertile black land, but increasingly “thin”.It is also the direction of the black land legislation to improve the soil quality, rationally utilize the land resources and promote the continuous restoration of the ecological function of the land.We will protect our clear waters, lush mountains and black land through scientific legislation. We will also enforce laws strictly and administer justice impartially. In early 2022, two seed and breeding cooperatives in Lushan County, Sichuan Province, filed a civil lawsuit against an agricultural and animal husbandry company for infringement of environmental pollution. The lawsuit alleges that the company repeatedly discharged sewage into their kiwi fruit plantation and adjacent farmland, causing damage to kiwi fruit trees and reduced production. In the course of the lawsuit, the plaintiff submitted an injunction application to the second Court of Chengdu Railway Transportation, which accepted the case, and applied for the defendant to stop the discharge of sewage to the macaque peach garden. After an investigation, the judge found that the defendant’s actions posed a significant risk of polluting the environment. The court issued the civil ruling and injunction within 48 hours, according to several Provisions on the Application of Injunction Preservation Measures in Cases of Ecological And Environmental Infringement, which came into effect on January 1 this year. This is also the first in-litigation injunction issued by the Supreme People’s Court after the implementation of the “injunction Provisions”.With environmental restoration, the species and number of animals are increasing. How to guarantee the harmonious coexistence between human and animals, and between human and nature has become a topic of great concern.Villager Wu Qingrong had a thrilling encounter in a pine forest near his village in March last year when he was collecting firewood when he heard the roar of a tiger. When he turned around, he saw a Manchurian tiger appear behind him, just over 30 meters away.Fortunately, the tiger left by itself and Wu was unharmed. On April 23, 2021, a Siberian tiger broke into Linhu Village, Mishan City, Heilongjiang Province, and a middle-aged female villager had a thrilling escape. The Siberian tiger was later controlled by rescue teams and sent to Hengdaohezi Feline Breeding Center in China for quarantine and observation before being released into the wild in May 2021.Siberian tigers are also seen in Hunchun, Wangqing and other places in Jilin Province. The sight from thousands of miles of frozen northeast, to the four seasons like spring south. In 2021, a herd of wild elephants from The Xishuangbanna Reserve in Yunnan province moved northward all the way, also affecting people’s hearts.Along the way, they broke into villagers’ homes to find food. When there are more and more rare wild animals, how to protect the animals and protect our own safety? And how to make up for the loss of property? The Wildlife Protection Law, which was revised in 2018, has relevant provisions. Now, in the process of implementation, local governments have also made useful attempts.According to Yu Wenxuan, director of the Institute of Environmental and Resource Law at China University of Political Science and Law, Yunnan province has taken the lead in setting up a public liability insurance for wildlife accidents. According to the relevant regulations, the local people’s government will compensate the farmers and the insurance company will also provide compensation.Compared with large wild animals, those small animals whose strength is much lower than that of human beings, such as the protection of precious birds or precious plants, the protection of soil, rivers and mountains, and so on, need the help of active law popularization and compliance by the whole people.According to statistics, up to now, China has more than 30 laws related to the ecological environment, as well as more than 100 administrative regulations and more than 1,000 local regulations, which has initially formed a legal system of ecological environmental protection.
